Plain-English Summary
YourPath is a free platform that helps families find senior-living resources. We earn revenue by sharing or selling your contact and related information to carefully selected partners — such as senior-living communities and care advisors — who can provide the services you're looking for. We believe in being upfront about this. You can opt out of the sale or sharing of your data at any time, and you retain the privacy rights described below. We treat your wellness information with extra care.
This Privacy Policy explains how YourPath.care (“YourPath,” “we,” “us,” or “our”) collects, uses, shares, sells, and safeguards personal information when you use our website and services (the “Services”). By using the Services, you agree to this Policy.
YourPath is the “controller” (or “business,” under California law) of personal information collected via the Services. This Policy does not cover independent third-party sites or services we link to — please review their policies separately.
Important: YourPath is not a covered entity under HIPAA. However, we treat wellness information as sensitive personal information and apply heightened safeguards, including encryption, access controls, and segregated systems. Where required by law (e.g., the Washington My Health My Data Act, Nevada consumer health data laws, or similar state “consumer health data” statutes), we will obtain separate, unambiguous consent before collecting, processing, sharing, or selling such data.
We may receive personal information from partners, referral networks, data brokers, analytics and advertising vendors, public databases, and affiliates. When we combine this data with information we collect directly, we treat the combined data in accordance with this Policy.
We use the personal information we collect for the following purposes:
By providing your telephone number through our Services, you expressly consent to receive telephone calls and text messages — including those made using automated telephone dialing systems (ATDS) or prerecorded/artificial voice technology — from YourPath and from the senior-living communities, care providers, and advisors in our network, regarding the services you have expressed interest in.
Your consent is not a condition of using or receiving our Services. Standard message and data rates may apply. You may revoke your consent at any time by any reasonable means, including replying STOP to any text message, calling us, or emailing hello@yourpath.care. We will process revocation requests within 10 business days, consistent with FCC requirements.
We maintain records of consent, including timestamps, IP addresses, and the specific form or page through which consent was given, to ensure compliance with the Telephone Consumer Protection Act (TCPA) and applicable state telemarketing laws.
We believe transparency about our business model is essential. Here is how and why your personal information is shared.
We disclose, share, and in some cases sell personal information — including contact details and the questionnaire information you provide — to the following categories of recipients:
Providing you with up-to-date options, tools, and human support at no cost requires us to finance the platform through data-driven referrals. Sharing or selling your contact and relevant profile information allows providers to evaluate fit quickly, reach out efficiently, and offer current pricing and availability. This revenue enables us to:
You can opt out of the sale or sharing of your personal information at any time (see Section 7 for instructions). We also honor Global Privacy Control (GPC) and other recognized universal opt-out mechanism signals as a valid opt-out request where required by applicable law. Opting out may reduce the number and speed of referrals you receive, but we will never discriminate against you for exercising your privacy rights.
We and our partners use cookies, pixels, web beacons, and similar technologies for the following purposes:
Managing Your Preferences: You can manage cookies through your browser or device settings. Blocking certain cookies may impact site functionality. Where required by law, we will present a cookie consent banner before placing non-essential cookies.
Global Privacy Control (GPC) & Universal Opt-Out Signals: We recognize and honor GPC browser signals and other recognized universal opt-out mechanisms as valid requests to opt out of the “sale” or “sharing” of personal information via cookies and tracking technologies, as required by applicable state law (including California, Colorado, Connecticut, Delaware, Montana, Oregon, Texas, and New Jersey).
We do not currently respond to legacy “Do Not Track” browser signals, as no uniform standard for such signals has been adopted.
We understand that the health and care information you share with us is deeply personal. Here's how we protect it.
Several states have enacted laws that impose specific requirements on “consumer health data”:
Where these or similar laws apply, we will present distinct, unambiguous consent before collecting, processing, sharing, or selling wellness questionnaire data. You may withdraw consent at any time (see Section 7). Withdrawal of consent does not affect the lawfulness of processing performed before withdrawal.
In compliance with the Washington My Health My Data Act and similar statutes, we disclose:
We respect your right to control your personal information. Depending on your location, you may have some or all of the following rights under applicable law.
You may submit a request by:
Verification: We will verify your identity before fulfilling a request, which may require matching information you provide against data we hold. If you use an authorized agent to submit a request on your behalf, we may require you to provide the agent with written permission and verify your identity directly with us, or the agent must hold a valid power of attorney.
Response Timeline: We will acknowledge your request promptly and respond within the timeframe required by applicable law (e.g., 45 days under the CCPA, extendable by an additional 45 days with notice).
If we decline to take action on your request, we will provide the reasons for our decision. You have the right to appeal that decision by contacting us at hello@yourpath.care with the subject line “Privacy Rights Appeal.” We will respond to appeals within the timeframe required by applicable law (typically 60 days). If you are not satisfied with the outcome of your appeal, you may contact your state's attorney general or applicable regulatory authority.
We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you different prices, provide a different quality of service, or retaliate in any way because you exercised a right under applicable privacy law. However, opting out of data sharing may limit the volume or speed of referrals we can provide, as our service depends on sharing your information with care providers who can assist you.
YourPath is free to users. Under certain state laws (e.g., California's CCPA), exchanging personal information for free services may be considered a “financial incentive.”
In addition to the rights described above, residents of certain states may have additional rights or require specific disclosures.
If you are a California resident, you have the rights described in Section 7 above. In addition:
| Category | Sources | Disclosed/Shared With | Sold? |
|---|---|---|---|
| Identifiers (name, email, phone, IP) | You; partners; data brokers | Referral partners; communities; vendors | Yes |
| Internet/network activity | Automatic collection | Analytics & advertising vendors | Yes (via cookies) |
| Geolocation (approximate) | Automatic (IP-based) | Referral partners; vendors | Yes |
| Sensitive PI (wellness data) | You (questionnaires) | Communities (with consent); vendors | Only with consent |
| Inferences & profiles | Derived from above | Referral partners; vendors | Yes |
| Commercial information (preferences) | You; partners | Communities; vendors | Yes |
If you are a Washington resident, the Washington My Health My Data Act provides additional protections for consumer health data. Please see Section 6 for our consumer health data privacy policy. You have the right to access your health data, request deletion (including from backups), know which third parties received your data, and withdraw consent to collection, sharing, or sale.
Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Oregon, Texas, Montana, Tennessee, Minnesota, Maryland, Delaware, New Hampshire, New Jersey, Nebraska, Iowa, Indiana, Kentucky, Rhode Island, and others as enacted) may exercise the applicable rights described in Section 7. Each state's specific requirements — such as appeal timelines, opt-out mechanisms, and data protection assessment obligations — are incorporated into our compliance program.
We retain personal information only as long as reasonably necessary for the purposes described in this Policy. Specific retention periods depend on the type of data and the context:
When personal information is no longer needed, we delete or de-identify it using commercially reasonable methods. Upon a verified deletion request, we will delete data from active systems and direct applicable third parties and service providers to do the same. Where required by law (e.g., Washington MHMDA), we will also delete data from archives and backups within a reasonable timeframe.
We use administrative, technical, and physical safeguards designed to protect personal information, including:
No method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and applicable regulators as required by law.
The Services are designed for adults and are not directed to children. We do not knowingly collect personal information from anyone under 16 years of age. If you believe a child under 16 has provided us with personal information, please contact us at hello@yourpath.care and we will promptly delete the information as required by applicable law, including the Children's Online Privacy Protection Act (COPPA) for children under 13.
Our Services are primarily intended for users in the United States. If we transfer personal information to jurisdictions with different data-protection laws, we implement appropriate safeguards (such as standard contractual clauses or equivalent mechanisms) to ensure your data receives a consistent level of protection.
Because our business involves collecting personal information and sharing it with third parties who may not have a pre-existing direct relationship with you, we may qualify as a “data broker” under certain state laws (e.g., California, Vermont). Where required, we will register as a data broker and comply with all applicable obligations, including:
A list of the categories of partners who may receive your information through our referral service — and who may contact you directly — is available by emailing hello@yourpath.care. We update this list periodically. While we vet our partners, we are not responsible for their independent privacy practices; please review their privacy policies directly.
We may update this Policy from time to time. The “Effective Date” above reflects the latest version. For material changes, we will provide conspicuous notice through one or more of the following: posting the updated Policy on our website, sending an email to the address associated with your account, or displaying a prominent notice on our homepage. Where required by law, we will obtain your consent before applying material changes. Continued use of the Services after the effective date of a revised Policy constitutes your acceptance of the changes.
